Delivery / shipping
The Uhrboerse company delivers goods - including possible partial deliveries - within 3 - 6 working days at the latest after receipt of payment by a forwarding company (value transport). Bindingly agreed contracts and deadlines become invalid if there are delays in delivery or performance due to force majeure or events that hinder the delivery process, such as official orders, operational disruptions or strikes. This also applies to material procurement difficulties, even if these are on the part of the supplier. The buyer undertakes to accept the delivered and ordered goods if changes to the type and quality have been made at his express request. If the goods are rejected or if he fails to accept them, the buyer is in default of acceptance. Should a further attempt at delivery fail, the Uhrboerse company reserves the right to raise a claim for damages in the amount of 20% of the order value (subject to proof of expected or occurring increased damage for the Uhrboerse company).
Prices and shipping costs
For our online published goods, we reserve the right to change prices at short notice and to adapt them to new circumstances and discrepancies caused by errors. Therefore, the verbally or in writing published prices for all our watches are non-binding.
The company Uhrboerse sends ordered watches within Germany, unless otherwise agreed, for a flat-rate shipping fee of € 30.-. The flat rate includes packaging, dispatch, postage and insurance per dispatch. For deliveries outside of Germany, we measure the flat-rate shipping costs individually according to the destination and the value of the goods.
Terms of payment
After agreement on the type of payment, the goods will be delivered, unless otherwise agreed, against bank transfer, PayPal, credit card by direct debit or. A different payment method can be agreed individually with the company Uhrenboerse. If the amount to be paid has been irrevocably credited to the account of the Uhrboerse company, the payment is deemed to have been made.
The following applies to default in payment: The Uhrboerse company reserves the right to demand interest that is up to 5% above the current discount rate of the Deutsche Bundesbank (or the guiding rate of the European Central Bank). Further damage caused by default may also be asserted.
Withholding or offsetting
If a counterclaim is to be offset or if a counterclaim is legally established, this entitles the customer to withhold or offset partial amounts. The right also applies if the counterclaim has been acknowledged in writing by Uhrboerse.
Retention of title
Retention of title applies to the goods until all of Uhrboerse's claims from the business relationship have been settled. This means that the company Uhrboerse reserves the right to ownership of the goods until all claims have been settled - this also includes future claims arising from contracts that were concluded at the same time or later.
The Uhrboerse company can also reserve ownership if individual or all of the seller's claims have been included in a current invoice.
